Louisville Nursing Home Neglect & Abuse Attorneys
The Commonwealth of Kentucky has strict laws in place to protect nursing home residents from abuse, neglect and exploitation. Unfortunately, abuse of the elderly happens every day in our society. The elderly are some of society’s most vulnerable people, especially when their living situation makes it clear that they cannot easily defend themselves. Nursing home abuse can happen in many different ways, but it is always damaging, whether financially, physically, or emotionally. As more and more of our elderly move to nursing homes, the opportunity for nursing home neglect and abuse increases. If you suspect a loved one has suffered neglect or abuse in a nursing home, contact the Louisville, Kentucky nursing home abuse lawyers at Mushlin & Vantrease, PLLC.
Kentucky Laws on Nursing Home Abuse and Neglect
Kentucky law, KRS Chapter 209, requires any suspected abuse or neglect to be immediately reported to Adult Protective Services (APS). This agency is charged with investigating complaints of abuse and neglect. Other agencies which should be alerted included the Office of the Inspector General and the Office of the Attorney General. All of these agencies may exercise power and authority to investigate complaints against nursing homes and take action to enforce the law, including fining or shutting down nursing homes or taking action against individual employees.
The problem with this approach is that government agencies have limited staff and resources to deal with complaints covering the more 23,000 residents in more than 300 nursing homes across the state. While the wheels of government are turning, you cannot wait and allow abuse and neglect of yourself or a loved one to continue. As private attorneys, Mushlin & Vantrease can intervene immediately, confronting the nursing home directly and/or filing actions in court as necessary. Through civil litigation, we can force liable facilities to change their policies and compensate the victims of abuse and neglect for the damages they have caused, including physical injuries as well as pain and suffering and emotional distress.
